On 2nd October, the State of New Jersey charged 51 defendants with gun trafficking and possession crimes, including three incidents in Middlesex County.
Joel Silberman1, Guns and Weapons Offense Lawyer in New Jersey says, “Federal and local New Jersey authorities spend significant energy seeking out those that possess illegal weapons, especially unregistered handguns. Prosecutors and Judges are extremely tough on weapons related offenses. Even first time offenders often face stiff prison sentences.” Ref: The Law Office of Joel Silberman, LLC, http://www.joelsilbermanlaw.com/our-practice/guns-aweapons-offenses/
A 40 year old man from Monmouth Junction, allegedly sold a rifle, illegally, in New Brunswick in July 2012. He was charged with unlawful possession and sale of a rifle and possessing a gun as a convicted felon. He faces five to 10 years in prison and five years of parole ineligibility for the possession of a weapon by a convicted felon charge.
A 39 year old man from Perth Amboy, was indicted on charges of unlawful possession and sale of a handgun in Perth Amboy in December, 2011. He is facing five to 10 years in prison on his charges. Along with him, a 46 year old man from Camden, were charged with conspiracy to sell a pistol grip, 12-gauge shotgun in Newark in January of 2012. They were indicted on Sept. 23. Both of them together are facing three to five years for the conspiracy charge.
A 38 year old man from Sayreville, allegedly sold a defaced handgun in Irvington in August of last year. He was charged on Sept. 23 with conspiracy, unlawful possession of a handgun, unlawful sale of a handgun and sale of a defaced firearm. He faces five to 10 years in prison.
The defendants were targeted as part of an initiative launched last year by State Police and the Division of Criminal Justice to aggressively combat gun violence in the state. A total of 67 guns were involved in the latest statewide crackdown, conducted from Sept. 16-30.
All across New Jersey, police are taking back illegally trafficked guns that are the most likely to be used in violent crimes."
This year, 65 defendants have been indicted in connection with offenses involving 94 guns. Last year, 57 defendants were indicted in connection with 87 guns as a result of the initiative.
Most of the defendants are subject to the Graves Act, which requires mandatory terms of parole ineligibility of up to five years.

TX man got punished by New Jersey gun laws for legally owned guns

A U.S. veteran and former police officer, Dustin Reininger is serving 3-5 years in a New Jersey prison for possession of firearms that he legally owned.

A U.S. veteran and former police officer, Dustin Reininger is serving 3-5 years in a New Jersey prison for possession of firearms that he legally owned. Because of New Jersey gun laws, Reininger was convicted of illegal possession of firearms as he was passing through the state.
Actually, Dustin Reininger is not from New Jersey. He was moving from Maine to Texas and was transporting his entire gun collection that day. He was driving through New Jersey when he parked his car in a parking lot to rest for the night. At night some police officers searched his vehicle without a warrant when they saw two gun cases in the back of the vehicle.
Under the Firearm Owners Protection Act, citizens are actually allowed to transport firearms from state to state regardless of the legality of the guns between departure point and destination. However, citizens must keep their firearms locked in either the trunk or a case. Reininger’s only mistake was keeping his firearms in an unlocked case.

Reininger is not a criminal. He is guilty of a technical violation. The purpose of America’s prisons is not to hold honest citizens guilty of accidental infractions, but to punish those criminals who have intentionally broken the law for personal gain.
And, if he had been living in New Jersey, he would have qualified for a state firearm ID card. His prison sentence will get over in some time, but his criminal record will remain because of which he may also lose the right to vote or own a firearm in the future.
